FACILITY GUIDELINES

365 Sports Complex Rules and Regulations

 

These rules are included, but not limited to, for the safety of all people and 365 sports complex.

• 365 Sports Complex reserves the right to refuse service to anyone.

• No athletic field use without prior approval from 365 Sports Complex staff.

• No firearms, Knives, ammunition, fireworks, flammable liquids.

• Disorderly conduct, obscene behavior, profane language or physical/verbal assault will not be tolerated. Violators will be banned from the premises.

• No Smoking of all tobacco products or any other any other substance.

• No Drugs allowed on premises. The law will be enforced.

• No alcohol consumption allowed on premises.

• No Glass bottles or containers on the premises

• All Minors not participating must be supervised by an adult at all times.

• Speed limit in the parking area is 5mph.

• No metal spikes allowed on the fields.

• No climbing on trees, goalposts, fences, structures, etc.

• No outside Food or drinks except for water.

• No bicycles, roller blades, scooters, ripstiks or other wheeled devices allowed on the         premises except for disability assistance.

• No gum allowed on the fields.

• No pets allowed on the premises.

• Players, Coaches and Officials only allowed on playing fields on game days or practices.

• No cooking or food preparation is allowed in the park without approval from 365 Sports Complex staff.

• No person shall engage in the sale of merchandise or operate any concessions without prior approval from 365 Sports Complex Staff.

• All advertisements, postings decorations and field markings must be pre-arranged and approved by 365 Sports Complex staff

• No loud music is allowed inside the facility

• No parking of vehicles on fields, sidewalks, service driveways and emergency zones.

• No overnight parking is permitted including RV’s and campers unless approved by 365 Sports Complex staff.

• No use of model planes, drones or rockets without approval from 365 Sports Complex staff.

• 365 Sports Complex may be closed at any time due to safety related reasons.

• No Littering and dumping trash on premises.

• No loitering or soliciting is allowed at 365 Sports Complex.

• Cars parked in handicapped parking spaces without a handicap sticker will be fined.

• Participation as spectators, coaches, players, vendors, walkers, runners, playground areas, and picnic areas are at your own risk. 365 Sports Complex is not responsible for injuries, stolen property or broken property. Be alert at all times.

• Failure to comply with these rules will result in immediate removal from the premises.

Code of Conduct

• No foul language such as profanity, blasphemy, obscenity, swearing, racism, sexism, and vulgarism allowed.

• If a player or any of his/her family and/or friends break our code of conduct or policy, they will be asked to leave. If refused to leave, the complex will be force to call the authorities and player/family/friends will lose their right to be admitted to the complex in the future. In addition, no refund will be issued for the player/family/friend.

• Harassment, bullying will not be tolerated at any time.

• Abuse or assault will not be tolerated at any time. Unfair and prejudicial treatment towards any person or group. Discriminatory phrases or words against another person. Examples include but are not limited to: personal attacks based on race, gender, age, religion, sexual orientation and physical abilities.

• Reporting misconduct will be confidential and will not be used for future reprisal against our players, teams and/or their family members and friends.

• No Illegal activities, such as vandalism, and robbery.

 

RELEASE OF LIABILITY, INDEMNIFICATION AND COVENANT NOT TO SUE HOLDER, ON BEHALF OF HOLDER, ANY ACCOMPANYING PARTY AND THEIR PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, NEXT OF KIN AND ANY OTHER PERSON OR ENTITY THAT MAY BE ENTITLED TO MAKE A CLAIM ON THEIR BEHALF, AGREE TO INDEMNIFY, DEFEND, WAIVE, RELEASE, DISCHARGE, HOLD HARMLESS, AND COVENANTS NOT TO SUE 365 SPORTS COMPLEX, ITS EMPLOYEES, VOLUNTEERS, OR ANY ENTITIES (AS DEFINED BELOW) (THE "RELEASED PARTIES") WITH RESPECT TO ANY CLAIM, LOSS, LIABILITY, COSTS, EXPENSE (INCLUDING ATTORNEY'S FEES) OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, (A) USE OF PREMISES, (B) PRESENCE AT THE PARKING LOT OR (C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (1) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (2) THE INHERENT RISKS ASSOCIATED WITH VISITING 365 SPORTS COMPLEX, INCLUDING, WITHOUT LIMITATION (a) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 AND/ OR VARIANTS OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTY OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTY; AND (b) ALL CLAIMS IN CONNECTION WITH THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO HOLDER OR ANY ACCOMPANYING PARTY. "365 SPORTS COMPLEX Entities" as used herein are Universo futbol Club, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with 365 SPORTS COMPLEX and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19, ITS VARIANTS or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable. I, player/ parent/ visitor and/or spectator, am responsible for my or my child health insurance and all costs that can be associated with it.
